The Legislative Framework for New Operators
Starting a road transport business means entering one of the most regulated commercial sectors in the UK. Before you can legally operate goods vehicles over 3.5 tonnes for hire or reward, you must satisfy the Traffic Commissioner on four criteria simultaneously — and a weak application, or one that overlooks problems in your background or financial position, will result in refusal or conditions that restrict your business from the outset.

Operator Licensing — The Four Criteria
Establishment
Your business must be genuinely established in Great Britain with an operating centre — a place where vehicles are normally kept when not in use. The operating centre is specified on your application and is subject to a public objection period during which residents and planning authorities can raise concerns.
Good Repute
You, your co-directors and any named Transport Manager must be of good repute. The Traffic Commissioner assesses repute against a specific list of offences and can make negative repute findings based on convictions or regulatory history. Financial Standing
As of 2026, you must demonstrate financial resources of £8,000 for the first authorised vehicle and £4,450 for each additional vehicle. Evidence must show funds genuinely available and accessible within 30 days — bank statements showing an average balance over three months, confirmed credit facilities or an appropriate insurance policy.
Professional Competence
Standard licences require a nominated Transport Manager holding the Transport Manager Certificate of Professional Competence (TM CPC). The TM must genuinely and continuously manage the transport activities of the undertaking — Traffic Commissioners are increasingly rigorous about nominal TM arrangements and will challenge situations where the named TM has no real involvement in the operation.
Drivers' Hours and Tachograph Compliance
EU drivers' hours rules under Regulation (EC) 561/2006 apply from your first day of operation. The key daily limits are nine hours driving per day (ten hours permitted twice per week), a 45-minute break after four and a half hours, and 11 hours minimum daily rest. Weekly limits are 56 hours maximum driving with a minimum 45-hour weekly rest.
Digital tachographs are mandatory for HGVs subject to EU hours rules. Driver card data must be downloaded at least every 28 days and vehicle unit data at least every 90 days. GB Type Approval — 2026 Update
From 1 February 2026, all goods vehicles sold into Great Britain must hold GB or UK(NI) type approval from the Vehicle Certification Agency. This affects vehicle purchasing decisions for new operators — verify type approval status before acquiring any vehicle sold after this date.
